In order to participate in the various contests and games (including fantasy games) available on Think11 platform ("Contest(s)") (the "Think11 Services"), a person ("User") must access Think11 (the " Think11 platform") and agree to be bound by these terms and conditions as well as any other guidelines, policies, and terms of use mentioned herein or supplied by Think11 in relation to any Think11 Service.
Think11 may at any time amend these Terms and Conditions, as well as any other rules, regulations, and terms of use referenced to herein or offered by Think11 in connection with any Think11 Service, by publishing the updated information on Think11 Website. Any User's access to all or any portion of Think11 or Think11 Platform Services may be restricted, suspended, or terminated at Think11 's sole and absolute discretion. Think11 may modify, put on hold, or stop the Think11 Platform Services entirely or in part; any content that a user may submit may be rejected, moved, or removed; Relocate or eliminate any content accessible on the Think11 Platform;
Think11 may, at its sole and absolute discretion, and without prior notice to the User, restrict, suspend, or terminate the User's access to all or any part of Think11 Contests or the Think11 Platform, deactivate or delete the User's account and all related information on the account, delete any content posted by the User on Think11, and take further technical and legal actions as it deems necessary in the event that any User breaches, or Think11 reasonably believes that such User has breached these Terms and Conditions, or has illegally or improperly used Think11 or the Think11 Services.
If Think11 charges its Users a platform fee for any Think11 Services, Think11 will promptly reimburse the platform fee in the event that Think11 suspends or removes the User's account or Think11 Services due to Think11 's negligence or deficiency. However, this refund will not be granted if Think11 's actions are motivated by the User's failure to comply with these terms and conditions or by any other circumstances outside of Think11's reasonable control.
Users agree to receive communications from Think11 or any of its partners, licensors, or collaborators, including notifications, administrative messages, and ads.
Content produced by Think11, its colleagues, licensors, partners, affiliates, and/or Users is combined into Think11. Think11, its partners, licensors, and/or associates own the intellectual property rights ("Intellectual Property Rights") in all software that powers Think11 and the Think11 Platform, as well as content published on Think11, including (but not limited to) games, contests, software, advertisements, written content, photographs, graphics, images, illustrations, marks, logos, audio or video clippings, and Flash animation. Without a specific written license from Think11, users are not permitted to alter, publish, transmit, take part in the transfer or sale of, replicate, make derivative works of, distribute, publicly perform, publicly display, or utilize any other method of commercializing any of the materials or content on Think11, in whole or in part.
Users may request permission to use any Think11 content by writing in to Think11 Helpdesk.
All content that users upload, post, email, transmit, or otherwise make available on Think11 (collectively, "Users' Content") are exclusively their responsibility, regardless of whether it is sent privately or publicly. Every user affirms and guarantees that none of the intellectual property rights in their content is violated by anyone, and that they are the exclusive owners of all such rights. Users additionally affirm and promise not to use or display on Think11 any names, logos, markings, labels, trademarks, copyrights, or other third-party intellectual property rights. In case of any third party claims arising from the display or use of names, logos, marks, labels, trademarks, copyrights, or other intellectual and proprietary rights on Think11, by the User or through the User's commissions or omissions, Users agree to indemnify and hold harmless Think11, its directors, employees, affiliates, and assigns against all costs, damages, loss, and harm, including litigation costs and counsel fees.
In this agreement, Users give Think11 and its partners, affiliates, licensors, and associates a worldwide, irreversible, royalty-free, non-exclusive, sublicensable license to use, copy, make derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish Users' Content for any of the intentions listed below:
Users' Content may be shown on Think11, distributed electronically or through other media to other Users who choose to download or obtain it, or stored in a distant database that end users can access for a fee.
Users' Content may be distributed and stored using any format, media, or technology under the terms of this agreement.
Any names, logos, marks, labels, trademarks, copyrights, or intellectual property rights on Think11 that belong to any individual (including Users), organization, or third party are acknowledged as proprietary to their respective owners. Think11 must be notified of any claims, disputes, or problems involving these names, logos, marks, labels, trademarks, copyrights, or intellectual property rights.
Think11 might have links to other websites that are run and owned by outside parties. The terms that each of those websites posts, if any, govern how users use those websites. Think11 has no control over websites other than Think11, and it is not liable for any content found on websites owned by third parties. If Think11 includes content from third parties or provides links to third parties' websites, it does not imply that Think11 supports those third parties' websites.
Users and third parties, including payment processors and providers of verification services, are the only parties to correspondence, transactions, offers, and related activity. The terms and conditions, policies, and other service terms adopted or implemented by the third party will apply to Users' correspondence, transactions, and use of the services/offers of said third party. It is the User's sole responsibility to review these terms and conditions prior to transacting or using the services/offers of said third party. The user acknowledges and agrees that Think11 shall not be held accountable or liable for any loss or damage of any kind resulting from any such deals or exchanges with other parties. Think11 disclaims all liability for the truthfulness, reliability, and quality of any content supplied by third parties. Users consent to follow these terms and conditions as well as all other guidelines, policies, and conditions pertaining to using the website. When registering and at all other times, users agrees to give truthful, accurate, comprehensive, and up-to-date information (as required by Think11). Users further agree to update and keep current their registration information.
Users understand and agree that, for the purposes of the Goods and Services Tax Act, any address-related information they may have submitted will be regarded as their "Address on record." Should there be a shift in such details, the user shall promptly update his/her profile on the Think11 platform or write to Think11 helpdesk.
It is forbidden for a user to create or manage multiple Think11 accounts.
Users acknowledge that by adding Think11's emails or SMSs to their "safe senders" list, they can receive all correspondence from Think11. If an email or SMS is routed to a user's spam or junk mail folder, Think11 will not be responsible for any unopened messages.
It is the users' responsibility to keep their passwords and accounts private. Users consent to reporting any unauthorized use of accounts or other security breaches to Think11 right away.
When a user ends a session, they consent to log out of their accounts. Think11 disclaims all liability for any loss or harm that could arise from the User's failure to adhere to these guidelines.
Users consent to refrain from using any unapproved third-party software intended to alter or interfere with Think11 Services and/or the Think11 experience, as well as from aiding in such activity, including cheats, exploits, automation, software, bots, hacks, and hacking.
The technology and software that underpin Think11 and Think11's services may not be copied, altered, rented, leased, lent, sold, assigned, distributed, reverse engineered, granted a security interest in, or otherwise transferred by users.
Users understand and agree that they will not alter or cause to be altered any files or software that are a component of Think11's Services without Think11's prior written approval.
Users consent to refrain from initiating, supporting, or participating in any kind of attack, including but not limited to virus dissemination, denial of service attacks, or other attempts to interfere with the use of Think11 Services by third parties or with anyone else's ability to use or enjoy Think11 Services.
Users agree not to use any method other than the user interface offered by Think11 to attempt to obtain unauthorised access to User accounts, Servers, or networks connected to Think11 Services. This includes, but is not limited to, evading or altering any security, technology, device, or software that supports or is a component of Think11 Services, as well as encouraging or helping others to do the same.
In addition to the aforementioned, Users consent to refrain from using Think11 for any of the following:
To act or speak in any way that is obscene, offensive, indecent, racist, communal, anti-national, disagreeable, defamatory, or abusive; To infringe upon, intimidate, harass, or otherwise violate anybody else's legal rights;
To publish, post, upload, email, distribute, or disseminate any offensive, vulgar, slanderous, infringement-causing, obscene, indecent, or illegal content (collectively, "Transmit");
To advertise, offer, or sell any goods or services for any commercial purpose on Think11 without Think11's express written consent; To transmit files that contain viruses, corrupted files, or any other similar software or programs that could damage or negatively affect the operation of another person's computer, Think11, any software, hardware, or telecommunications equipment;
To download any material, reassemble, dismantle, or otherwise work with our goods that you know, or should have a reasonable suspicion, cannot be obtained lawfully in this way;
To obliterate or falsify any author credits, proprietary designations or labels, legal or other proper notices, or the source of software or other content; to prevent or limit the use and enjoyment of any public section on our websites by any other user;
To gather and retain personal data about other users;
Interfering or disrupting Think11, servers, or networks; Posing as someone else, including a Think11 representative; Making up a false identity or misrepresenting the User's relationship to a person or organization;
To alter IDs, headers, or other data in order to conceal the source of any content sent via Think11 or to influence a user's appearance on Think11;
to engage in any activity that places an excessive or unreasonable burden on our infrastructure;
To take part in any illicit activity. By using our message or communication facilities, chat rooms, news groups, forums, communities, and/or bulletin board services (collectively, the "Forums"), you consent to using them exclusively for the purpose of sending and receiving content appropriate for that specific Forum.
To take any action that jeopardizes India's unity, integrity, defense, security, or sovereignty, cordial relations with other countries, public order, or that encourages the commission of any crime that is punishable by law or obstructs an inquiry.
If a user chooses a username that Think11 deems to be vulgar, offensive, abusive, or that could bring Think11 into disgrace or ridicule, or if the user chooses a name that is an official team, league, franchise, or sporting celebrity name, Think11 reserves the right, without giving the user advance notice, to restrict usage of names that fall into any of the aforementioned categories, to change the username and notify the user, to remove the username and any posts from Think11, or to deny access to Think11, among other options.
Unauthorized access to Think11 is against the law and these terms and conditions. Users consent to only use the interface Think11 provides to access Think11; they will not access Think11 in any other way. Users agree that they will not access, monitor, or copy any portion of our sites using any automatic means, including without limitation agents, robots, scripts, or spiders, unless those automated methods have been allowed in writing and in advance by us.
Think11 use is governed by current laws and legal procedures. Nothing in these Terms and Conditions will restrict Think11's ability to abide by demands or laws pertaining to Users' use of Think11 from governmental bodies, courts, or law enforcement agencies.
It is prohibited for anybody under the age of eighteen (18) to take part in any paid contests or games (under any name) on the Think11 Platform. In order to gain access to the Think11 Platform, users will need to reveal their true age. Any content posted by users on Think11 is not the responsibility of Think11. By entering this contest, the user attests that he or she is doing so on a personal level and not as part of their business or profession.
By participating in a Contest, the user consents to be bound by Think11's judgments and these Terms. If a user engages in unfair conduct that the Think11 deems to be improper, unfair, or otherwise adverse to the operation of the Contest or is in any way detrimental to other Users, it may, at its sole discretion, disqualify the user from a Contest, refuse to award benefits or prizes, and require the return of any prizes. All of the aforementioned actions are subject to the terms and conditions outlined below.
Faking one's own personal information, such as name, email address, bank account information, and/or any other data or evidence that Think11 may need in order to participate in a contest, claim a reward, or win; Entering a contest or claiming a prize by engaging in any kind of financial fraud or misrepresentation, such as using credit/debit cards, payment wallet accounts, etc. without authorization. It is made very clear that the user will have the whole burden of proving otherwise.
Collaborating with any other user or users, or participating in syndicated play of any kind; any infraction of the Terms of Use or the Contest rules; gaining rewards or points by unsanctioned techniques such automated bots or other automated ways;
utilizing automated methods (such as harvesting bots, robots, parsers, spiders, or screen scrapers) to acquire, gather, or access any user or website data for any purpose any abuse of the Invite Friends program, any Discount Bonus, or any other offers or promotions;
Attempting to interfere in any manner with the computer programs or security measures connected to a contest, or interfering with the way a contest is administered;
Obtaining information about other users without that users' knowledge or consent, or spamming other users (spamming can refer to a variety of activities, such as sending unsolicited emails to users, sending bulk emails to Think11 users, or sending unwanted email content to a subset of users or all users); or abusing the website in any way (some examples of abuse include using slang, unparliamentary language, or offensive language).
It is made clear that Think11 retains the right, in addition to forfeiture and/or prize money recovery, to pursue proper Civil/Criminal remedies in the event that a User is determined to have violated this policy.

Think11 may provide the contest(s) on the Think11 platform as part of its services.
The following competitions are currently offered on the Think11 platform: There are ___________ different types of fantasy sports games available: 1) fantasy cricket, __________. The contest is open to individual users who wish to participate as "Participants" (hereafter referred to as "Team/s"). These teams must be made up of real-life athletes such as Cricketers, _______________(depending on the sport) who are involved in the real-life match, series, or tournament (hereafter referred to as "Sports Event") that the fantasy game is related to.
At the conclusion of a specified match, match, or tournament of the Contest(s), teams are awarded points based on the real-life performances of cricketers or other sport players (as applicable). Winners ("Winners") will be the Participant(s) whose Team(s) earn the highest cumulative score(s) in the Contest(s). There may be more than one winner in some pre-specified contests, and the rewards will be awarded to these winners in ascending order of their team's total score at the conclusion of the contest's scheduled match or matches.
The Contest(s) are currently offered on the Think11 platform in paid forms. By paying the pre-designated fee as stated on the applicable Contest website, users may enter the Contest(s). The term "pre-designated amount" refers to the pre-determined participant contribution to the prize money pool as well as the pre-determined platform charge for using Think11 services. As specified on the applicable Contest(s) page, the Participant who finishes the pre-arranged match with the highest total points will be eligible to win a reward that has already been assigned and will be paid out of the prize money pool.
A Participant may create multiple Teams to compete in Contest(s) related to a sporting event using all of the Think11 Services. However, Participants understand and agree that they may only enter one team in any contest presented in connection with a sporting event, unless Think11 specifically states otherwise in reference to any Contest ("Multiple Entry Contest"). A Participant may enter more than one Team in a single Multiple Entry Contest in the event of multiple entry contests. Furthermore, it is made clear that Think11 has the right to periodically limit the maximum number of Teams that can be formed by a single User account (for each contest format) or which, in each case, to the number that Think11, in its sole discretion, determines that a single User account may enter in a certain Multiple Entry Contest.
Contest prize money will be split equally among all participants in two-member and above public contests where all players entered with the exact same teams, including the captain and vice-captain in such an event. Half of the money will be deposited in each player's Think11 winning account, and the remaining portion will be credited to their Discount Bonus account. The Company maintains the right to take appropriate action against users who are found to be in violation of this policy, including but not limited to forfeiting the Discount Bonus Amount. In Think11's Starting Lineup Feature, the indication of a player's involvement in the final starting lineup serves solely to inform and help the user choose their squad. Think11 bases its decision to include a player in the starting lineup on information obtained from feed sources and publicly accessible statistics. It is recommended that users conduct in-depth independent research using official and/or other accessible sources. If a player who was previously listed as "Playing" does not play or start for any reason, Think11 will not be held responsible.
In the recent case of Shri Varun Gumber vs. Union Territory of Chandigarh and Ors, the Punjab and Haryana High Court ruled, among other things, that the fantasy sports activities supplied by the operator were "games of skill" as defined by Indian law and did not qualify as gambling. In addition, the Honorable High Court ruled that providing fantasy sports activities on fantasy portals constituted a legal commercial activity that qualified for protection under Article 19(1)(g) of the Indian Constitution.
The aforementioned Contest (across the Think11 Services) are skill-based games because the success of the participants is largely dependent on their superior knowledge of cricket games, statistics, players' relative form, and their performance in a specific territory, conditions, and/or format (e.g., ODIs, test cricket, and Twenty20 in the cricket fantasy game), as well as their attention to detail and skill in playing the Contest. In order to score as many points as possible, players must field evenly distributed teams with few resources.
Each participant understands and acknowledges that they are playing a game of skill by taking part in this Contest(s).
Only individuals who are at least eighteen years old may enter the paid edition of the contest.
The contest(s) is/are exclusively available to individuals who presently reside in India.
The states of Andhra Pradesh, Telangana, Assam, Nagaland, and Sikkim do not provide Think11's paid version of the contest(s), and users from these states are not allowed to enter the contest(s).
Upon receiving information, Think11 has the right to prohibit an individual from participating in any particular event or match and/or withhold winning sums if it is determined that the individual has insider knowledge of the participating teams, as well as to organize boards, leagues, etc.
To be eligible to enter the Contest and win prizes, Participants must have successfully registered on Think11 and registered before each match in line with the above-described protocol.
Users agree to be bound by the following payment conditions for any transactions they make on the Think11, including paying to play the paid versions of Contest(s):
The Think11 portal offers several Contest, for which it maintains the right to impose a Platform Fee. Think11 will specify and notify users on the Contest page before they participate in the contest. Along with the entrance fee for the Contest, the Platform Fee and any relevant tax will be deducted from the User's account balance. Think11 will send the User an invoice for this deduction.
The User may participate in a Contest wherein the User must make a predetermined contribution to the Contest's Prize Money Pool, which will be distributed to the Contest's Winner or Winners upon completion of the Contest in accordance with the Contest's terms and conditions; it is made clear that Think11 has no ownership or right to this Prize Money Pool and merely serves as an intermediary involved in collecting and distributing the Prize Money Pool in compliance with the Contest's terms and conditions; additionally, the amount that the User must pay in to the Prize Money Pool will be deducted from the User's account balance with Think11. For the purpose of processing and reconciling payments pertaining to the Think11 Services, Think11 offers users three types of accounts:
The Earned Account will be credited with the User's winnings from any contest. It is made clear that Think11 will never allow the transfer of any funds from the user's accounts to any other type of account they may have with Think11 or to any third-party account, including a third-party bank account.
Through the specified payment mechanism, users must send Think11 the necessary amount. Each time a user enters a round, the appropriate amount for that round's participation will be deducted from their account, and the payout will be credited to their accounts. Think11 will first debit the user's "Cash Bonus Account" when deducting funds from their accounts for the user's participation fee in any round or contest (subject to any restrictions or guidelines pertaining to the use of Cash Bonus that may be specified by Think11 and relevant at the time), and thereafter, any remaining amount of participation fee shall be debited from the User’s Earned Account. In the event that the user has any outstanding balances related to their involvement in any round or contest, they will be sent to the appropriate payment mechanism to complete them. If the user adds more money through this payment gateway than the remaining participation fee, the extra money will be deposited into the user's "Deposits" account and can be used to participate in any round or contest or to withdraw money in line with these terms and conditions.
Debits from the ‘Deposits’ Account to enable a user’s participation in a Contest shall be made in order of the date of credit of amounts in the ‘Deposits’ Account, and accordingly amounts credited into ‘Deposits’ Account earlier in time shall be debited first.
By contacting Think11 Customer Support, a user may remove any funds credited to their "Deposit" account for any reasonable cause. Within 335 days after credit, all funds credited to a user's "Deposit" account must be used. Should any unused funds remain in the "Deposit" Account after 335 days have passed since the date of credit, Think11 retains the right to forfeit such funds without incurring any liability or obligation to reimburse the user.
Any amount standing to the User's credit in the Earned Account may be withdrawn by submitting a request to Think11, but it will happen automatically once 335 days have passed since the day the amount was credited to the User's Earned Account. Either way, within a commercially reasonable timeframe, Think11 must make an online transfer to the User's bank account that is on file with Think11. The user's earned account will be debited as a result of the transfer. For the online transfer of such funds from the Earned Account to the User's bank account on file with Think11 may impose any processing fees.
Users are asked to be aware that in order for Think11 to complete their withdrawal request, they will need to present legitimate picture identification and proof of address documentation. The name on the user's photo identification document should match the name they gave when they registered on Think11, as well as the name and address that are on file for their bank account that they gave to Think11.
To Think11's satisfaction and in compliance with these Terms and Conditions, Think11 will notify the User at least 30 days before the Auto Transfer Date via the email address that is on file with Think11 if the User has not registered a bank account with Think11 or has not verified their User account with Think11. If the User does not register a bank account with their User Account or verify their User Account by the Auto Transfer Date, Think11 has the right to forfeit any funds that are due on the Auto Transfer Date.
Failure to provide Think11 with a valid bank account or valid identification documents (to Think11’s satisfaction) may result in the forfeiture of any amounts subject to transfer in accordance with this clause.
No User may transfer or request the transfer of any money into the Cash Bonus Account, which will contain funds that Think11 has generously given to the User for use in participating in any Contest. The use of any funds issued and available in the Cash Bonus Account is subject to the limitations and restrictions imposed by Think11 and communicated to the user at the time of issue. These limitations and restrictions include, but are not limited to, time constraints on how the funds must be utilized.
Think11 has the last say over how much money is issued to the Cash Bonus Account, and no user has the right to demand it. Any amount issued by Think11 on any given day does not give the user the right to demand that the same amount be issued at any later time or to anticipate that Think11 will release the same amount to them on a regular basis. In compliance with these terms and conditions, the User may use the amount standing to their credit in the Cash Bonus Account only to offset the participation cost in all potencies.
Apart from being part of a user's earnings in any contest, the amount standing to the user's credit in their cash bonus account cannot be withdrawn or transferred to any other user's account, including their bank account, or to any other user or person's account. All funds remaining to the user's credit in the Cash Bonus Account will be returned to Think11 in the event that the user or Think11 terminates the user's account; the user will not have any claim or interest in these funds.
Users acknowledge that they will be responsible for paying for and being obligated by a transaction after they confirm it on Think11.
The user understands that it could take up to 24 hours for transactions to be completed on Think11. It may take up to 24 hours for any money paid or transferred into the user's "Deposits" or "Earned" accounts to appear in the balance of those accounts. In a similar vein, funds that are taken out of the user's Cash Bonus Account, "Deposits" Account, or Earned Account might not show up in the user's balance for up to 24 hours. Users agree not to file a complaint or make a claim against Think11 for any delays, including missed opportunities to participate in Contest or rounds because the transaction amount was not credited to their accounts in a timely manner.
In the event that the user's bank or the source bank prevents the withdrawal amount transaction from Think11 via instant bank transfer, the user's money will be returned to their Think11 wallet within 24 to 48 hours. If the user's bank or the source bank puts a withdrawal transaction made through Think11's instant bank transfer mode into pending mode, we ask that the user wait T+2/3 working days for the bank to clear the transaction.
Think11 may get the score feed and additional data from third-party service providers and/or the official match organizer website in order to calculate and tabulate fantasy points. The squads' scores in a specific round of the Contest (which could last anywhere from one day to an entire tournament) will determine the winners. The winner or winners will be the participant or participants who own the squad or squads with the highest overall score in a given round. At the conclusion of the allocated round of the Contest, Think11 may declare multiple winners in some pre-specified Contest and award rewards to the winners in ascending order of their squad's total score. While Joining any contest user will be directly shown all the squads he has created and to join the contest with multiple squads the exact contest joining amount for selected number of squads will be deducted for joining the contest.
Before joining contest if user sees a vacancy to join a contest with multiple squad , before completion of the process of the user if the contest is joined by any other users so , the total remaining spaces will be given to the first selected squads of the user and the renaming squads will be added to the newly created contest.
In order for the squad to show up in the switch area, the user ought to have created multiple squads.
In order for that squad to show up in the swap area, the user should not have joined the same contest as that team.
In order to switch squads, the match should be in impending mode.
In order for the actual swapping to occur, the user must click the done button after choosing the new squad to be switched with the existing team and clicking the swap option.
Should the swapping procedure fail, the user must constantly verify if the switching was successful; if it did not, Think11 is not responsible for the function's failure as a result of the user's actions. No questions will be answered.
Swapping a squad from contest would not cost user any extra charges.
Before forming or joining the private contest for a certain match, the user must first assemble a squad.
For a single match, the user may construct a maximum of two Private Contest. A contest cannot be edited or deleted after it has been created.
The user is unable to join a contest with bonus cash or create one with bonus cash.
The secret contest code for the created contest can be found on the user's view standings screen for that specific match.
The contest entry amount will be taken out of the user's account after he clicks "create contest."
To join a private contest, a user must have a private contest code.
There should be a least of two participants and a maximum of fifty when making the private contest. The minimum winning sum should be Rs. 10,000, and the maximum winning amount might be Rs. 20,000.
If the contest is not completely filled, the winnings are divided according to the proportion (%). The top 40% team will receive an equal share of the new winnings if there are fewer entries than winners.

They will not be responsible for Think11's failure to alert the User if they fail to give Think11 real information.
Any failure to perform due to unforeseeable circumstances or causes beyond Think11's control, such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials, or any cancellation of any cricket or other match to which a Contest relates, shall not bind Think11 in any way. In these situations, Think11 will also have the right to revoke any associated contest(s) and provide each participant with a suitable reimbursement.
Any right or term of these Terms and Conditions that Think11 does not exercise or enforce shall not be deemed a waiver of that right or provision.
Users understand and agree that any claim or cause of action arising out of or connected to use of the Think11 or these Terms must be filed within thirty (30) days of the claim or cause of action arising, regardless of any statute or law to the contrary, or it will be permanently barred.
